Exciting SALT Update

Overview: The final Tax Cuts and Jobs Act (TCJA) has immediate and far-reaching state and local tax implications that will require consideration by the active engagement of all tax departments and C-suites.

This presentation will explain how the TCJA provisions affect state and local taxes, how the state legislatures may respond and a more detailed view of the California implications of various provisions of the TCJA.

EY’s panel of professionals will discuss these developments and what they mean for businesses throughout the US. Some of the topics to be discussed include the following:

  • State income tax implications:

  • Conformity issues
  • Application by the states of the federal transition tax (imposing an immediate tax on the last US shareholders’ 2017 return on CFCs’ accumulated foreign earnings intended to transition the US to the new territorial international tax system)
  • Anti-deferral provisions
  • Anti-base erosion provisions
  • Interest expense limitation
  • New federal net operating losses rules: Will the states follow?
  • Application at the state level of the deduction for owners of pass-through entities (e.g., partnerships, LLCs, S corporations and sole proprietors)
  • Tax accounting considerations
  • California considerations
